Defendant, State Farm Mutual Automobile Insurance Company (State Farm), appeals the summary judgment entered in favor of plaintiff, C. Douglas Thurman. We reverse and remand with directions.
State Farm provided $100,000 per person bodily injury uninsured/underinsured motorist (UIM) coverage under a policy issued to plaintiff. After suffering bodily injury in an automobile accident, plaintiff settled with the liability insurance carrier for the driver of the car that caused his injury (tortfeasor) for $35,000, which was the full amount of bodily injury coverage available to…
