Plaintiff brought this declaratory judgment action after its property was specially assessed by defendant’s city council for a portion of the costs of improving a street upon *36which the property abuts. Defendant appeals from the trial court judgment declaring the assessment of plaintiffs property invalid and ordering defendant to refund payments made by plaintiff thereunder.

Plaintiff owns a retail store and warehouse facility on the corner of Groesbeck Highway and East-land Avenue in Roseville. The building runs lengthwise along Eastland and fronts on Groesbeck. Plaintiff also owns vacant land…
