MEMORANDUM OPINION AND ORDER

DANIEL, District Judge.

This matter is before the Court on Defendant Larry Porter’s Motion for Dismissal *762Pursuant to Rule 12(b)(1), filed May 20,1996, wherein he argues that this Court lacks subject matter jurisdiction. As discussed below, I agree and order the case dismissed. The matter has been fully briefed, and I am well versed in the premises.
