The briefs of counsel have been of little practical aid to the court in this case, and the brief of counsel for plaintiff in error especially has been prepared with such an utter disregard of the rules of this court as to warrant an affirmance of the judgment without an examination of the record for the alleged error. There is general confusion of statement of facts, assignments of error and argument, and an entire failure to set out instructions and evidence objected to.
