This appeal is from a conviction for the theft of one head of cattle, the property of some person to the grand' jurors unknown, wherein the punishment assessed was a term of two years’ imprisonment in the penitentiary. The evidence of both thé State and the defense established the fact that the “one certain head of cattle” alleged to have been taken by the appellant, was taken by him and Dan Sisk from the range of G. HENDERSON, Judge.

Appellant in this case was tried under an indictment charging him with the theft of one head of cattle; was convicted, and given two years in the penitentiary; and from the judgment and sentence of the lower court he prosecutes this appeal. The appellant assigns as error the action of the court in permitting the District Attorney, in his closing argument to the jury, to criticise the action of the defendant in failing to introduce in evidence a written bill of sale, in his possession, of the animal in controversy.
