This is a scire facias on a municipal claim, filed by the borough against two separate piece's of land owned by the defendant. The borough, without a petition of property owners, enacted an ordinance providing for the grading and paving of the roadway of South Hopewell Avenue and for the payment of the cost of the improvement, one-third by the borough and two-thirds by an equal assessment on the foot-front of real estate abutting upon the line of the street as improved.
