This is an action by the appellee against the appellant to recover for moneys alleged to have been unlawfully allowed to the appellant for his services as county assessor of Boone county by the board of commissioners of said county, and wrongfully paid to him out of the county’s funds. Appellant’s demurrer to the complaint was overruled, whereupon he filed a verified motion to dismiss the case, which was also overruled by the court.
