Appeal from an order of the Supreme Court (Kahn, J.), entered October 1, 1993 in Albany County, which, inter alia, granted plaintiff’s motion to strike defendant’s counterclaim.

Plaintiff and defendant were married in January 1989. The parties’ relationship thereafter deteriorated and on January 28, 1993, plaintiff forwarded to defendant a partially executed separation agreement prepared by Stewart Pintón, the attorney then representing plaintiff.
