Plaintiff, Ralph M. Knecht Sr., sustained severe injuries on September 19,1997 when he was run over by a dump truck which was backing up on a section of Interstate Highway 80 during a repair project. He filed a complaint on April 7,1999 naming as defendants, Michael Durso d/b/a Durso Trucking Company and John David, the driver.
