The cause was heard before the vice-chancellor of the first circuit, who dismissed the bill with costs ; which decision was affirmed by the chancellor. [377] The parties are agreed in relation to the most material facts of this case, which will be found to lie within a narrow compass. In November, 1817, William Seward contracted an obligation to the appellant, on which his .responsibility, as subsequently ascertained "by the judgment, amounted to nearly $3000.
