I dissent.

It appears that about the first of March, 1933, Mr. Maughan, superintendent of the Logan City light department, and a member of the Citizens Eelief Committee, directed an employee of his department, also a committee member to supervise the removing of a large tree standing on the property of the defendant, Anderson Lumber Co., on the South Main Street of Logan City, which tree was on the east side of the street and practically upon the property line and just inside of the fence marking the east boundary of the sidewalk.
