In pursuance of the granting of a petition for rehearing, this cause is before the court En Banc upon an appeal taken by the city of Seattle from a judgment of the superior court for King county, reducing certain local improvement assessments levied against properties of Stone & Easter and James R. Wood, by the authorities of the city to aid in paying the expense of improving Tenth Avenue Northeast.
