¶ 1. We review a decision of the court of appeals1 that granted resentencing based on ineffective assistance of counsel, *297which reversed the circuit court's2 denial of Danny Robert Alexander's motion for resentencing. Alexander contends his Fifth Amendment right not to be sentenced based on an improper factor was violated at sentencing because compelled, self-incriminating statements to his probation agent were appended to the report of the presentence investigation (PSI) the circuit court reviewed.
