BACKGROUND

On October 2, 1996, a coalition of environmental and wildlife conservation groups (“Conservation Groups”) filed suit seeking a declaratory judgment and injunctive relief to prevent the United States Army Corps of Engineers (“Corps”) from proceeding with a flood control project known as the Mississippi River Mainline Levee Enlargement and Berm Construction Project (“Project”).
