MEMORANDUM OPINION AND ORDER

This matter is before the Court on a motion by plaintiff Coopers & Lybrand, Ltd., (“plaintiff” or “Coopers & Lybrand”) for summary judgment under Bankruptcy Rule 7056, which makes Rule 56 of the Federal Rules of Civil Procedure applicable in adversary proceedings. The complaintalleges that a debt of defendant Robert Vaughn Gibbs (“defendant” or “Gibbs”) to plaintiff is nondischargeable in bankruptcy under 11 U.S.C. § 523 (the “Bankruptcy Code” or “Code”), and that defendant should be denied a discharge of all of his debts under…
