—Upon the facts thus presented, a conclusion is to be reached and announced whether plaintiff: is entitled to any relief.

That plaintiff owed the city nothing and the beneficiaries in the deed of trust nothing, stands conceded. That Carter’s bondsman owed the city $7,700 is equally undisputed.
