In this cause an appeal was taken to, and •decided by, this court at last term, reported in 80 N. C., 81, w-herein the- decree of the court below, setting aside a sale of land made by its authority to 0. H. Moss and D. G. Rice, was affirmed and a certificate’ of the opinion directed to be issued.
At the last term of the superior court of Henderson county, upon the coming down of the certificate from the supreme court, the cause stood for hearing, when the parties agreed upon and prepared a decree by consent, which was present■ed to and signed by the judge and filed in the cause.
