Before the court is the motion of the defendant, Nationwide General Insurance Company, for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. 1 This matter arises out of an accident involving Dale Autry (hereinafter Dalé), a minor and son of the plaintiff, Janet Autry. On April 26, 1992, an unidentified vehicle allegedly caused Dale to lose control of his bicycle, fall to the ground, and suffer personal injury.
