Action of contract in which the plaintiff, a landlord, seeks a recovery on two counts, one for rent due under a lease, and one for use and occupation. The defendant filed answers of general denial and payment.

There was evidence to the effect that there were two corporations, each incorporated in Massachusetts, July 21, 1939, one corporation, Berger’s Lucky Seven Moto-Stores, Inc., having three incorporators and the other corporation, Lucky Seven Moto-Stores, Inc., having four incorporators, two of the four being incorporators of the other corporation.
