BRADX, J.
For convenience, D. J. Burk, the plaintiff in error, will be referred to in this opinion as the plaintiff, and G. B. Estes, the defendant in error, as the defendant.
Plaintiff, a real estate broker, sued defendant for a commission for effecting an exchange of lands between defendant and one Davis.
