This suit was brought by ap-pellee against Harrison Building Company for certain commissions and brokerage. _ The basis of this suit is predicated upon the following contract:
“Date: May 12th, 1927.
“We hereby make 'application to B. F. Ditt-mar Co. (Inc.) of San Antonio, Texas, for a loan of $35,000.00 for the term of 7 years, payable in gold coin of the United States of America, with interest at 7 per centum per annum, payable semiannually, and to be secured by a first mortgage (or trust deed) on the property hereinafter described, and to be payable as follows, to wit: 5% semiannually,…
