1Opinion of the CourtBlair, J.

John R. Bigham, the regularly elected, qualified, and acting sheriff of Bell county, Tex., filed in the district court of that county, in the manner and form required by statute, his account for fees of office accruing during the January term, A. D. 1925, of said court. The application for approval of the account was heard by the judge of the court in term time, as required by law, and upon an agreed statement of facts signed by the sheriff’s attorneys on the one hand and by the district attorney on the other hand, representing the state of Texas.
