MURRAY, Chief Justice.
This is a motor vehicle collision case. It was instituted by Maltón A. Buehring in the District Court of Goliad County, Texas, against Butane Wholesale Company, Inc., and Hubert Wayne Rose, seeking to recover damages resulting from a collision between a pick-up truck driven by Bueh-ring and a tractor trailer tank truck driven by Rose and belonging to Butane Wholesale Company.
