Error to a judgment of the Circuit Court of the city of Lynchburg, rendered May 16, 1892, in an action of trespass-on the case, wherein the defendant in error was the plaintiff, and the plaintiff in error was the defendant.

This is a writ of error to the judgment of the Circuit Court of the city of Lynchburg in an action on the case instituted by the American Exchange Bank, for the benefit of T. F. Jamison & Co., against the Chesapeake and Ohio Bail-way Company, for damage alleged to have been done to two car-loads of horses and mules whilst being transported over the defendant’s line of road.

The defendant filed a plea to the jurisdiction of the court. To this plea the plaintiff demurred, but the court overruled its demurrer, and it then filed a special replication to the plea, upon which issue was joined and a…
