SCHWELB, Associate Judge:

On July 28, 1992, Russell Brown, who was serving a sentence as a youthful offender 1 at the Lorton Youth Center, died of asthma. On July 27, 1993, Brown’s mother, Linda Wilson, brought this action against the District of Columbia, pursuant to the wrongful death 2 and survival 3 statutes, alleging medical malpractice and other negligence. The case went to trial on March 25, 1996, and on April 2, 1996, the jury returned a verdict in the plaintiffs favor in the amount of $277,-418. 4 On August 22, 1996, the judge denied the District’s post-trial motion to set the verdict…
