BACKGROUND

This cause comes before the court on the defendant’s motions for . summary judgment based on federal preemption [81] and on state law grounds [83]. ■ The court has *898reviewed the briefs, exhibits, and relevant law and is prepared to rule.

This is a failure to warn products liability case. The plaintiffs are the family of Leon Cross. The defendant is Forest Laboratories.
