¶ 1 This consolidated appeal involves two pharmaceutical product liability lawsuits concerning the drug Januvia, which is manufactured and marketed by the defendant, Merck Sharp & Dhome Corp. (Merck). The two lawsuits involve four plaintiffs, who allege their family members died of pancreatic cancer caused by their use of Januvia.
