The plaintiff below, who is also the plaintiff in error, sued the Camden and Atlantic Railroad Company to recover damages for personal injuries.

The evidence on the part of the plaintiff shows that the accident out of which the injuries to the plaintiff arose occurred at Berlin, in the county of Camden, on March 23d, 1891, about five o’clock in the afternoon.
