Action of tort in which the plaintiff seeks to recover damages for injuries received by her on a train operated by the defendant, on or about November 21, 1943. The plaintiff’s declaration contains three counts, the first alleging that the plaintiff was a passenger on a train of the defendant arriving at Boston; that its agents *49and servants negligently announced prematurely that the train had arrived at Boston and brought the cars to a stop and opened the gates; that the plaintiff sought to alight from the train in accordance with the defendant’s invitation when the car suddenly started…
