BRYANT, Judge.

Where the North Carolina Industrial Commission had subject matter jurisdiction over plaintiff’s workers’ compensation claim, and where *417plaintiff failed to prosecute his claim, we affirm the Commission’s dismissal of plaintiff’s claim with prejudice.
