MEMORANDUM ON DISCHARGE

HAROLD LAVIEN, Bankruptcy Judge.

The Plaintiff in this proceeding, William H. Tucker, the United States Trustee, seeks to bar the discharge of the Debtor, Bernard A. Devine, pursuant to Section 727 of the Bankruptcy Code. The Plaintiff relies on subsections (a)(3) and (a)(7), which provide:
