KNÍGHT, Circuit Judge.

This appeal is from a judgment of condemnation of one acre of land for school purposes and an award of damages based upon the verdict of a jury, and from an order denying new trial.

Appellant seeks to rely upon assignments to- the effect that the evidence was insufficient to support the judgment, but has failed to cause it to affirmatively appear that his brief contains all the material evidence received upon the trial as required by section 3149, R.
