Appeal from a judgment of the County Court of Rensselaer County (McGrath, J.), rendered February 11, 1999, upon a verdict convicting defendant of the crimes of rape in the third degree and sodomy in the third degree.

Defendant was charged with a number of sex-related offenses as the result of his relationship with a 15-year-old girl. In a statement to a child protective services caseworker, defendant admitted having sexual relations with the girl numerous times over a one-year period. Upon his arrest, defendant stated that these relations were consensual and that he intended to marry the girl.…
