MEMORANDUM AND ORDER

DITTER, District Judge.

In this action, I am presented with a recurring question arising under section 33(b) of the Longshoremen’s and Harbor Workers’ Compensation Act 1 -whether a longshoreman’s right to commence a third-party negligence action may be statutorily assigned to his employer without “an award in a compensation order filed by the deputy commissioner or [the Benefits Review Board].” Because the express terms of section 33(b) foreclose such a construction, I hold that the mere receipt of compensation payments by a longshoreman does not trigger a statutory…
