The accused, Howard, was convicted by general court-martial sitting at Augsburg, Germany, of three breaches of restriction and of possession of a false pass with intent to deceive, all violations of Article 134, Uniform Code of Military Justice, 50 USC § 728. On affirmance by intermediate reviewing authorities, this Court granted accused’s petition for review, limited, however, to the following questions: (1) whether the evidence was sufficient to sustain the convictions, and (2) whether the instructions by the law officer to the court-martial were…
