—In an action, inter alia, to recover damages for fraud, the defendant Wayne Piasio appeals from a judgment of the Supreme Court, Nassau County (Martin, J.), dated April 13, 2001, which, upon a jury verdict, is in favor of the plaintiff and against him in the principal sums of $150,000 for compensatory damages and $375,000 for punitive damages. Presiding Justice Prudenti has been substituted for the late Justice O’Brien (see 22 NYCRR 670.1 [c]).

Ordered that the judgment is modified, on the law, by deleting the provision thereof awarding the plaintiff punitive damages in the principal sum of…
