HUTCHINSON, Justice.

This is an appeal from the granting of a motion for summary judgment.

Appellant, Richard John Voelker, Jr., and appellee, Hera, f/k/a Betty Calvert Voelker, were formerly husband and wife. Ap-pellee filed this suit to collect the balance due on a promissory note, together with interest and attorney’s fees, and to foreclose her security interest in certain property owned by appellant which secured the payment of the note. The note and security interest were awarded to appellant, by agreement, in the divorce decree between the parties.
