The purpose of this action is to obtain a decree quieting plaintiff’s title to the use of certain of the waters of Swimming Woman Creek, in Fergus County. It was removed to this court by appeals by the defendant, P. I. Moule, from a final judgment and an order denying a new trial, and also from a special order after judgment “overruling and denying the exceptions filed by the defendant, P. I.
