MEMORANDUM AND ORDER
ALLEN SHARP, District Judge.
The salient facts that are necessary to determine the defendant’s Motion for Summary Judgment are simple and straight forward. The plaintiff’s decedent was severely injured when a Piper Pawnee PA 25-235, serial number 25-3263 and FAA identification number N 7317Z crashed near Logansport, Indiana on July 7, 1978. As a direct result of injuries sustained in that crash John R. Dague died on September 5, 1978.
