On the 5th day of November, 1874, Edward Creighton died intestate, at Omaha, leaving a large estate, consisting of both real and personal property. He left no issue, and his personal estate descended to his wife, whom we shall hereafter refer to as Mrs. Creighton. On the 20th day of March, 1875, the defendant was appointed administrator of the estate of the intestate by the county court of Douglas county.
