Defendant was accused by information of the crime of grand theft and was convicted at a jury trial. He has appealed from the judgment of conviction and from the order denying his motion for a new trial.

It is now contended that the evidence is insufficient to justify the conviction. Andrew S. Thomson, a salesman for the American Cheek Writer Company, parked his automobile in front of his residence in the city of Los Angeles on February 28, 1940, at about 4:45 P. M.
