LAY, Circuit Judge.

Sylvester Louis Bordeaux, a.k.a. Mano Bordeaux, was originally charged for attempted aggravated sexual abuse by force in ■violation of 18 U.S.C. § 2241(a)(1). 2

On the charge of attempted aggravated sexual abuse, the jury returned the verdict form with a note stating, “After all reasonable efforts, we, the jury, were unable to reach a verdict on the charge ‘Attempted Aggravated Sexual Abuse.’ ” However, the jury did find the defendant guilty of the lesser included offense of abusive sexual contact by force in violation of 18 U.S.C. § 2244(a)(1). 3 While sentencing was…
