This is an action of contract to recover damages for the failure of the defendant, a common carrier, to deliver a bundle containing twenty-one coats to the plaintiff’s consignee by a certain date, and for unreasonable delay in returning the goods to the plaintiff. There was evidence that these were seasonal goods, upon which the plaintiff placed a value of $75 when they were left with the defendant for shipment, and that after the goods were refused by the consignee, the plaintiff “shopped around and sold them for $25.” The judge found for the plaintiff in the sum of $50.
