EVERETT, Chief Judge:

Private Byrd was tried at Fort Gordon, Georgia, by a military judge sitting as a special court-martial. Pursuant to his pleas, appellant was convicted of attempted distribution of marijuana on June 7, 1983, and possession of some amount of marijuana on June 29,1983, in violation of Articles 80 and 134, Uniform Code of Military Justice, 10 U.S.C. §§ 880 and 934, respectively. His sentence was bad-conduct discharge, confinement for 99 days, forfeiture of $250.00 pay per month for 6 months, and reduction to Private E-l. The findings and sentence were approved by the…
