Appeal from a judgment of the superior court for Walla Walla county, Miller, J., entered May 4, 1910, upon a trial and conviction of perjury.

In February, 1910, the appellant Smails was informed against by the prosecuting attorney of the county of Walla Walla, for the crime of perjury in the first degree, the charging part of the information being as follows :

“Everett J. Smith, prosecuting attorney of and for the county of Walla Walla, in the state of Washington, on behalf of said state accuses Harvey Smails of the crime of perjury in the first degree, and informs the court that at the courthouse in Walla Walla, the colmty seat of said county, on the 12th day of January, 1910, in and before the superior court of said state for said…
