Appeal from a judgment of the County Court of Tioga County (Squeglia, J.), rendered April 25, 1997, upon a verdict convicting defendant of the crime of manslaughter in the first degree.

It is undisputed that defendant fatally shot his son-in-law, Christopher Allen, on April 20, 1996. The shooting occurred following a regularly scheduled supervised and uneventful visitation between Allen and his infant son at defendant’s home.
