The plaintiff in error will hereinafter be referred to as the defendant. The information contained two counts: first, that the defendant did on the 28th day of *652July, 1923, at said county of Barron, feloniously kill and slay one Neis Ronning; and the second count charges the unlawful operation of an automobile upon and along a certain highway at a rate of speed exceeding thirty miles per hour.
