The plaintiff in error, hereinafter referred to as plaintiff, is a minor, and was the owner of certain real estate located in Okfuskee county, Okla. Through his duly appointed guardian an application was made through the probate court of Hughes county, Okla., for permission to sell an 80-aere tract of land in Okfuskee county, Okla. An order was entered authorizing the guardian to sell at public outcry said land, and at the sale the land was struck off to W. S.
