Titis action was brought under the federal Bankruptcy Act (Act July I, 1898, cb. 541, 30 Stat. 544 [U. S. Comp. St. 1901, p. 3418]) to recover an alleged preference. This is the second appeal. See 39 Utah, 518., 117 Pac. 800, for first appeal. This appeal was argued and submitted during the February, 1913 term. An opinion affirming the judgment was handed down before the commencement of the May term of that year, but pending the latter term appellant’s counsel filed a petition fqr a rehearing, which was granted, and the judgment of affirmance was set aside, and the case was again thrown at…
