Plaintiffs in error, hereinafter called plaintiffs, filed their petition in the superior court of Pottawatomie county, on July 10, 1931, in which they alleged in substance that on or about the 3rd day of March, 1930, they entered into an oral contract with the defendants in error Lamb'ard-Hart Loan Company and Chas. H.
